GENERAL

These Terms of Service ("TOS"), either as amended from time to time by Deep Dive Plumbing and Drain llc., a limited liability company, its subsidiaries, affiliates, predecessors, successors and assigns ("Deep Dive," "us," "we" and/or "our"), between you ("Client," "you" and/or "your") and Deep Dive, sets forth the terms applicable to your purchase and/or use of our products and services (collectively, the "Services"). You andDeep Dive together may be referred to herein as the "Parties" and each may be referred to herein as a "Party." This TOS explains our obligations to you, and your obligations to us in relation to any Services you purchase or otherwise utilize. These TOS apply to our provision of service plumbing repair services only.

By signing up for our products and/or services, you acknowledge that you have read, understand, and agree to be bound by this TOS, as well as all other applicable rules or policies, terms and conditions, or service agreements that are or may be established by us from time to time and are incorporated herein by reference. You may also elect to purchase additional Services (the "Additional Services") from us, our partners and/or other third parties, which may have their own service agreements or other related terms and conditions, and it is your obligation to review, accept, and abide by those service agreements or other related terms and conditions.

These Terms of Service may be updated from time to time by posting on the website.

NOTICE AND COMMUNICATIONS

All notices from us to you are deemed effective when: (i) sent by certified mail, return receipt requested or by Federal Express or other recognized overnight delivery service to your last known mailing address; (ii) sent via e-mail to your last known Customer contact e-mail address; (iii) sent via fax to your last known fax number; or (iv) posted on

and/or any of the applicable pages linked thereto, as updated from time to time.

When you provide contact information to us, you expressly agree that we may use this information to contact you in any format or manner we choose (including but not limited to by telephone, fax, text/SMS, email or direct mail). We may, but have no obligation to, send a single notice by various means of delivery (i.e., fax, e-mail, text/SMS, certified mail or express mail). In no event shall we be liable to you for choosing to send notice in one manner or format over another.

You authorize us to contact you via the contact information provided in your account information that we deem is of potential interest to you. Notices and announcements may include commercial e-mails, telephone solicitations, texts/SMS and other notices describing changes, upgrades, new products and services or other information. If you do not want to receive non-service related communications, you may withdraw your consent at any time, by clicking the link in a communication or contacting our customer support at customerservice@deepdiveplumbing.com. Consent is not a condition for purchasing services from us.

We'll ask for your permission before sending you text messages. You can choose to opt in when you visit us in person or during a phone call with our team. When you first register with us, we'll ask for your phone number and see if you'd like to receive helpful text messages like billing notifications, appointment reminders, dispatch updates, and job completion surveys.

We'll also let you know that message and data rates may apply, message frequency may vary, and you can text HELP for support or more information. If you ever change your mind, just reply STOP at any time, and we'll stop sending you messages.

You shall give Notice to us by contacting our Customer Service at the phone number listed on our website or otherwise provided by us.

TERMS AND CONDITIONS

Applies to all quotes, invoices, work orders, and services

These Terms and Conditions govern all plumbing and drain services provided by
Deep Dive Plumbing & Drain LLC, DBA Deep Dive Plumbing (the "Company") to the customer ("Customer").

IMPORTANT NOTICE
By accepting a quote, authorizing work, signing an invoice or work order, or making payment, Customer acknowledges that they have read, understand, and agree to these Terms and Conditions. These Terms are continuously available at

and are incorporated by reference into every quote, invoice, work order, and payment authorization.

DEFINITIONS

Company - Deep Dive Plumbing & Drain LLC, DBA Deep Dive Plumbing, including its owners, officers, employees, agents, and authorized representatives.

Repair - Any work performed to correct, restore, modify, install, or service an existing plumbing, water, drain, or sewer system component that is not expressly defined as a Replacement.

Replacement - The complete removal and installation of a new system or fixture, limited strictly to the following:

  • Full water heater replacements, including tank and tankless units

  • Garbage disposals

  • Toilets

  • Water service lines

  • Sewer service lines

  • Whole-home water repipes

Any installation, change, replacement, or new install not listed above shall be deemed a Repair and carries a one (1) year warranty only.

1. CUSTOMER RESPONSIBILITIES

Customer represents that all plumbing, water, drain, and sewer systems are in acceptable condition unless disclosed prior to service.

Customer agrees to hold the Company harmless from discovery of pre-existing, concealed, or defective conditions, including but not limited to:

  • Improper or faulty plumbing

  • Broken, settled, collapsed, or deteriorated lines

  • Rusted or defective piping

  • Illegal or non-code-compliant conditions

  • Chemical, acidic, or corrosive drain conditions

  • Electrical or structural defects

All permits, inspections, approvals, and required code upgrades are the responsibility of the property owner unless expressly stated in writing.

2. PAYMENT TERMS

Payment is due prior to the start of work and/or immediately upon completion, at the Company's discretion. The Company does not extend credit.

Returned checks are subject to a $35 fee plus the face value of the check, as permitted by Georgia law.

ALL WARRANTIES ARE VOID IF PAYMENT IS NOT MADE WHEN DUE.

3. NO REFUNDS POLICY

ALL SALES ARE FINAL. NO REFUNDS ARE PROVIDED FOR SERVICES RENDERED.

Customer acknowledges that plumbing and drain services involve labor, diagnostics, and materials that cannot be returned once work has been performed.

This no-refund policy does not replace or eliminate the Company's limited warranty obligations for covered defects in materials or workmanship as expressly stated below.

4. STANDARD OF WORK

The Company will perform work in a competent and workmanlike manner consistent with industry standards.

The Company is not responsible for existing illegal, unsafe, or non-code-compliant conditions.

Any work arranged directly with a technician outside of this agreement is considered side work, is strictly prohibited, and carries NO WARRANTY, NO REFUND, AND NO LIABILITY of any kind.

5. DRAIN CLEANING & STOPPAGE TERMS

READ CAREFULLY - DRAIN SERVICES ARE LIMITED

A. DRAIN CLEANING SERVICE LIMIT

Drain cleaning service includes up to ONE AND ONE-HALF (1.5) HOURS of active machine operation time.
Setup, teardown, inspection, and diagnostics are included in that time.

FULL PAYMENT IS DUE REGARDLESS OF WHETHER THE DRAIN IS COMPLETELY UNSTOPPED.
There is NO GUARANTEE that any drain can be fully cleared.

If additional time is required, additional charges will apply upon Customer approval.

B. DRAIN WARRANTY LIMITATIONS

  • TOILET STOPPAGES ONLY: FORTY-EIGHT (48) HOUR WARRANTY

  • ALL OTHER DRAIN STOPPAGES: THIRTY (30) DAY WARRANTY

ALL DRAIN WARRANTIES ARE LIMITED TO ONE (1) RETURN VISIT AND UP TO ONE (1) HOUR OF DRAIN CLEANING TIME.

NO WARRANTY GUARANTEES THAT A DRAIN WILL REMAIN CLEAR OR CAN BE COMPLETELY UNSTOPPED.

6. WARRANTY TERMS

A. WARRANTY COVERAGE

  • Repairs: One (1) year

  • Replacements: Two (2) years only for items specifically listed in the Replacement definition

Warranty coverage applies only to labor and materials provided by the Company unless otherwise stated in writing.

B. NO WARRANTY - READ CAREFULLY

THE FOLLOWING WORK IS PERFORMED AT CUSTOMER'S OWN RISK

NO WARRANTY IS PROVIDED FOR ANY OF THE FOLLOWING:

  • POLYBUTYLENE PIPE REPAIRS - NO WARRANTY, CUSTOMER ASSUMES ALL RISK

  • GALVANIZED PIPE REPAIRS - NO WARRANTY, CUSTOMER ASSUMES ALL RISK

  • Cast-iron pipe repairs

  • Customer-supplied parts or materials

  • Work altered, repaired, or serviced by others

  • Failures due to age, corrosion, settlement, ground movement, or normal wear and tear

  • Damage caused by pressure fluctuations, chemicals, or environmental conditions

Drain & Sewer Exclusions

  • Grease, roots, or scale

  • Toilet stoppages beyond the 48-hour warranty

  • Foreign objects including wipes, feminine products, paper towels, toys, or non-septic-safe materials

Drain stoppages are NOT GUARANTEED to be resolved.

The Company is not responsible for damage to toilet bowls caused by auger use.

C. ADDITIONAL LIMITATIONS - READ CAREFULLY

THE FOLLOWING ITEMS ARE EXPRESSLY EXCLUDED FROM ANY WARRANTY OR LIABILITY:

  • NO WARRANTY COVERS WATER DAMAGE, FLOODING, OR SEWER BACKUP DAMAGE OF ANY KIND

  • EXCAVATION WORK IS NOT WARRANTED FOR EROSION, SETTLING, SOIL MOVEMENT, OR LAND SHIFTING

  • LANDSCAPING, LAWNS, SPRINKLER SYSTEMS, CONCRETE, ASPHALT, PAVERS, DRIVEWAYS, AND ALL SURFACE RESTORATION ARE EXCLUDED

  • BACKFILLING IS PERFORMED TO ROUGH GRADE ONLY - FINAL GRADING, COMPACTION, AND RESTORATION ARE NOT INCLUDED

Warranties are non-transferable and apply only to the original Customer.

7. LIMITATION OF LIABILITY

Customer's sole and exclusive remedy is repair or replacement as expressly provided in these Terms.

The Company shall not be liable for incidental, indirect, or consequential damages, including property damage or loss of use.

The Company is not responsible for damage resulting from misdiagnosis when services are performed in good faith and without gross negligence.

All implied warranties, including merchantability and fitness for a particular purpose, are limited to thirty (30) days, to the fullest extent permitted by Georgia law.

8. PROTECTION OF PROPERTY

Customer is responsible for removing or protecting personal property.

The Company is not responsible for damage to flooring, drywall, cabinets, tile, finishes, landscaping, hardscape, or sprinkler systems caused by necessary access or the normal consequences of work.

Customer is responsible for securing pets, children, gates, and access areas.

9. ENTIRE AGREEMENT AND GOVERNING LAW

These Terms constitute the entire agreement between the parties and supersede all prior discussions or representations.

The version of these Terms in effect on the date a quote is accepted or service is performed governs that work.

This agreement shall be governed by the laws of the State of Georgia.

The Company does not provide itemized breakdowns of labor or materials.

Marketing statements, service descriptions, and promotional language do not modify or expand warranty coverage beyond what is expressly stated in these Terms and Conditions.
